State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The principle is that a lawyer is an agent whose relationship with his client is governed by the provisions of general law concerning the relationship between principal and agent. The provision in Article 32 of Law No. 42 of 1964 concerning the legal profession conferring on the judge authority to assess the lawyer's fees if the client disputes them. Then the amendment of that article by Law 62 of 1996 and the exclusion of the former provision concerning assessment of the lawyer's fees in the event of a dispute over them mean that the legislator intended thereby to leave this matter to the provisions of general law, namely the Civil Code provisions on agency, owing to the absence of conflict. Example. - 61 - Law
