Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 31

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Recourse to the general law is permissible only regarding provisions omitted by the special law. The reason for that. - Special legislation is an exception to the legislation preceding it only insofar as it specifically regulates matters. - Subsequent general legislation does not implicitly repeal earlier special legislation.
