State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A void contract produces no effect. It is considered such from the time of its conclusion. The consequence thereof: restoring the contracting parties to the position they occupied before contracting whenever feasible. If that is impossible, the judge may order equivalent performance. - A void contract is a nullity. Its implication: the barring of the nullity action by the lapse of 15 years from the date of the contract does not mean that the contract has become valid. - Rules concerning the opening and ownership of shops and establishments for the purpose of engaging in trade. Their regulation by the legislature through Law 32 of 1964. Its purpose. Establishing safeguards for Kuwaitis’ ownership and exploitation of the licence and prohibiting its issuance to non-Kuwaitis. That prohibition concerns public policy.
