Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3193

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The nullity of a contract concluded by a non-Kuwaiti in breach of the prohibition contained in the Commercial Code or any other legislation prohibiting a non-Kuwaiti from engaging in commerce in Kuwait requires restoration of everything to its original state and recovery by each contracting party of what he gave, if feasible. If this is impossible for either contracting party, the judge may order him to render an equivalent. - The principle of enrichment requires the enriched party to repay the two values of the enrichment at the time it occurred or the impoverishment at the time judgment is rendered.
Arabic original
