State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judicial claim. A procedure addressed to the court against the opposing party, whereby the scope of the action is determined. The court must adhere to that scope when deciding the action. - New claims are inadmissible on appeal. The grounds may be changed while the original claim remains. An example concerning equivalent performance. - An award of equivalent performance or compensation resulting from unjust enrichment. Based on the rules of tort liability, not on the void contract. It entails a change in the grounds of the action, not a change in its subject matter.
