Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3403

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Liability arising from custody of a thing requires, for its establishment, that the damage arise from the act of the thing itself. The burden of proving this falls upon the injured person. Where a presumption of a causal relationship arises, liability is displaced only by the custodian proving an external cause. An example in which those conditions were not met.
