Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3578

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The binding effect of a criminal judgment before the civil court. Extends only to facts necessarily determined concerning the act constituting the common basis. Between the criminal and civil actions, and to the legal characterization of that act and its attribution to its perpetrator. Example of absence of the common-basis condition: acquittal of the custodian or his subordinate does not bind the civil judge. Rationale. Fault in liability for things is presumed, whereas fault in a criminal action must be proved.
