State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The exercise of a right cannot give rise to censure or entail liability. Its limit: that it was not intended to cause vexation or obstinacy and was not accompanied by any form of negligence or fault. Reason thereof. - Diverting the exercise of a right from the purpose for which it was established and exercising it in a manner that does not harm another. Entails liability for the damage suffered by that other person. - Enforcement of judgments is a judicial procedure. Its condition: directing enforcement against the judgment debtor and verifying the identity of the person against whom enforcement is pursued. This rests on the applicant for enforcement; otherwise, compensation must be paid to the injured person for the damage suffered by the person against whom enforcement is pursued if it transpires that he is not the judgment debtor.
