Unlawful exercise of a right. Its forms. The common criterion among those forms is the intention to harm others, positively, by deliberately seeking to harm others without any benefit accruing to the holder of the right thereby, or negatively, by deliberate disregard of the grave harm suffered by others through the right-holder's exercise of his right in a manner approaching an intention to cause deliberate harm.

الاستعمال غير المشروع للحق. صوره. الضابط المشترك بين تلك الصور هو نية الإضرار بالغير ايجاباً بتعمد السعي إلى مضارة الغير دون نفع يجلبه صاحب الحق من ذلك أو سلباً بالإستهانة المقصودة بما يصيب الغير من ضرر فادح من استعمال صاحب الحق حقه استعمالاً يكاد يبلغ قصد الإضرار العمدي.Original Arabic judgment citations
