Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3779

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Guaranteeing personal injury that entails Sharia diyah. Its payment is borne by the person who directly caused it. Definition of the direct actor in Islamic jurisprudence. Example: a speeding car colliding with another parked alongside the pavement and the death of the driver of the first. Its consequence. The damage did not result directly from the parking of the second, because a matter intervened between that act and the damage, namely the impact caused by the first.
