State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Gross and intentional misconduct that relieves the direct perpetrator of liability. Its nature. - The challenged judgment's conclusion, within its discretionary authority, that the appellant was the direct perpetrator because his act itself brought about, without an intermediary, the injury that caused the death of the respondents' deceased predecessor, and that this liability is neither negated by the absence of fault on his part nor removed merely by the injured party's committing a fault, so long as he did not intentionally injure himself or it was the result of gross and intentional misconduct on his part. Challenging it. An argument concerning matters independently assessed by the court of merits. Impermissibility of raising it before the Court of Cassation.
