Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 534

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The existence of a special law. Its effect. No recourse is made to the provisions of the general law in matters not regulated by the special law. The reason thereof. The special legal rule does not repeal the general rules but constitutes an exception to them, so that both enactments continue to operate together, each within its scope. The implication thereof. The rule that an employee transferred from one entity to another retains the last salary received before transfer, established by special legislation and conflicting with the rule regulated by general legislation that makes the salary of the position grade to which the employee is transferred the criterion for determining that employee's salary, is the rule that must be followed, lest the purpose for which the special law was enacted be defeated. The judgment's adherence thereto. No defect.
