Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 692

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Personal status matters are a distinct collection of a person's natural or familial attributes to which the law attaches an effect in his social life as a human being, male or female, and which the legislature has surrounded with special procedures and safeguards. The implication thereof. Judgments rendered therein have absolute binding authority against everyone, irrespective of whether those judgments declare or create the rights they contain. The reason therefor. Judicial truth in personal status matters is no more than a declaration of a legal position, status or attribute inherently characterized by unity, absoluteness and indivisibility. Its necessary consequence: it is absolute and general against everyone and accepted by them.
