Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 920

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The right to report crimes. One of the rights lawfully available to persons. The mere falsity of the report and occurrence of harm to the person reported against. Insufficient to render the reporting person liable for compensation. He must have intended malice and harm to those reported against, or the report must have been made hastily, recklessly, and without caution. The reporting person's belief in the truth of his report or his having suspicions justifying reporting. No basis for holding him liable. Mere inability to prove the reported facts. Does not conclusively establish the falsity of the report. The reason: judgments must be based on certainty and conviction, not conjecture and probability.
