Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 921

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The party seeking indemnity. May not seek a judgment against the indemnifier for what the claimant in the original action seeks to have adjudged against the party seeking indemnity. His right is confined to seeking a judgment against the indemnifier for whatever may be adjudged against him in respect of those claims. An example of a reasonable inference ordering the claimant in the incidental indemnity action to bear the costs of his action.
Arabic original
