Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1104

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court's obligation to examine a challenge alleging absolute simulation. Its condition: that it be explicit in its meaning, on the basis that the apparent contract has no existence in reality. Merely challenging on grounds of fraud and collusion between the parties to a sale contract does not constitute evidence of its simulation.
