State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The doctrine of unforeseen circumstances. The prerequisite for application is that, after conclusion of the contract and before completion of performance of the obligation arising therefrom, an exceptional event of a general nature occurs which was not contemplated and could not have been foreseen at the time of contracting, and which renders performance of the obligation onerous. - Occurrence of the unforeseen event after performance of the obligation. Leaves no room to demand reduction of the obligation.
