State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The State’s substitution for the creditor in enforcing the assigned right against the debtor pursuant to the provisions governing assignment of rights insofar as they do not conflict with the provisions of Law 41 of 1993. Its effect. Transfer of this right to the assignee State with its attributes and real and personal securities. The assignment is effective against the debtor against whom the right is assigned and against third parties from the date the Law takes effect, the debtor’s acceptance thereof or his notification thereof, whichever of these dates is earliest. - Assignment of debt. Its nature and effect. The new relationship resulting therefrom determines the position of both the assignor—the original debtor—and the transferee and the rights of each against the other in a manner wholly disconnected from the previous relationship, its attendant characteristics and the defenses arising from it. - 281 - Obligation
