Creation of a commercial instrument as a means of payment. It gives rise to an obligation under the instrument alongside the original obligation. The creditor has the choice of recourse against the debtor by an action on the instrument or an action on the original debt. - Extinction of the action on the instrument by prescription. The original debt remains in existence, as does the action protecting it. Its effect. The creditor may have recourse thereby against the debtor to recover his debt.
