English translation of the principle

Judicial set-off. What is required for effecting it. Raising it by way of an incidental claim submitted by the defendant in response to the original action. Requesting it by way of a defense or requesting it for the first time before the Court of Appeal. Impermissible. The basis for this. Article 85, Civil Procedure Code. - Basing an appeal on an ineffectual contention or on a ground which, even if valid and requiring cassation of the judgment, would confer on the appellant only a purely theoretical interest. The appellant has no interest in it. An example concerning a request for judicial set-off.
