State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Impossibility of performance resulting in extinguishment of the obligation. It is objective impossibility relating to the obligation itself, not to the person of the debtor, and rendering performance absolutely impossible for everyone, not for the debtor alone. - 371 - Obligation - An obligation to pay a sum of money is, by its nature, always capable of performance and is not subject to objective impossibility.
