Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 219

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Requirements for enforcement of judgments. Among them is that the person against whom enforcement is directed must be the judgment debtor. Verification of the identity of the person against whom enforcement is pursued. Falls upon the applicant for enforcement. Proof that the person against whom the procedures were directed is not the judgment debtor. The applicant for enforcement is obliged to compensate him for the harm whenever the elements of liability are present. An example concerning the challenged judgment's failure to notice the failure to exercise the necessary accuracy and caution in enforcement, which harmed the person against whom enforcement was pursued, falls within abuse of the right to litigate, and gives rise to a right to compensation, rendering the judgment defective and requiring its cassation.
