Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2197

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Possession of real property and appearing in relation to it as its owner for fifteen years constitutes a Sharia and legal presumption of the possessor's ownership. He may add the period of his possession to that of his predecessor to complete the legally prescribed period. - Ascertainment of possession, its manifestations, and the facts establishing its material and mental elements as evidence of ownership, determination of its commencement and continuity, and assessment of the evidence in the action are matters of fact within the independent discretion of the trial court, provided it bases its decision on reasonable grounds capable of leading to the conclusion it reached. For that purpose, it may adopt the expert's report, if satisfied with it, as an integral supplement to the reasons for its judgment.
