State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The insured’s right to liability compensation for an accident, arising by operation of law from the harmful act, is what passes to the insurer that paid the insurance amount to the insured or the injured party. - The subrogation action brought by the insurer against the third party responsible for the accident. It is not considered to arise from the insurance contract. It is not subject to the three-year limitation provided for in Article 807 of the Civil Code, but is time-barred by the same period applicable to the insured’s action. Its period begins not from the date of payment of the insurance amount, but from the date on which it began to run in respect of the insured.
