Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 263

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity extinguishes the contract from the time of its conclusion and removes every effect of its performance if it has been performed. The consequence: restoring everything to its original state and each contracting party recovering what he gave, if that is feasible. If this is impossible for either contracting party, the judge may require him to render equivalent performance to him. Example.
