Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2801

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The seller’s warranty against latent defects and his warranty of the description of the property sold. The legislature distinguished between them. It devoted a special provision to the second, making the contract the basis of the seller’s obligation to warrant the description. The implication thereof: the short prescription prescribed for the lapse of an action under the warranty against latent defects does not apply to an action under the warranty of description.
