Kuwait Court of Cassation principle number 288

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The nullity or annulment of a contract. Its effect: extinguishing the contract from its conclusion, treating its performance—if any—as though it had not occurred, and restoring the contracting parties to the position they occupied when contracting. Requiring one party to the contract to compensate the other to the extent of the benefit accruing to the enriched party and the loss sustained by the impoverished party. This is subject to the assessment of the court of merits.
