State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Revocation of a gift where the donee does not consent. Its condition. The absence of any impediment to revocation. This is unaffected by whether the impediment existed from the making of the gift through fulfillment of the donor's purpose or arose after it was made. Article 537 of the Civil Code. - Existence of an impediment to revocation of a gift. Its effect. Rendering the gift binding. The donor alone may not seek its rescission, even if one of the legally prescribed excuses for revocation exists. - Establishment of an impediment to revocation of a gift. Its effect. It becomes binding. - A change in the donated thing itself or an inseparable addition to it that increases its value. Its effect. Giving precedence to the donee's right over the donor's right, for the right of ownership is stronger than the right of revocation. Example.
