Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 315

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An injury resulting in death. The injured person's capacity, even a moment before death, to acquire rights, including the right to compensation for the harm sustained; whenever this right is established for him before death, his heirs receive it from him as part of his estate. They may claim it on the basis of liability having arisen under the contract of carriage to which the deceased was a party. This compensation differs from the compensation that the heirs may claim for the material and moral harm they personally suffered owing to the death of the deceased, which may be recovered from the carrier on the basis of the rules of tort liability.
