Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3197

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Loans contracted by banks are commercial acts for both parties. Other loans are not commercial unless their purpose is to expend the borrowed sums on commercial activities. The determining factor is the borrower's intention at the time of contracting, not the ultimate use of the borrowed money. Basis for this. An example of a judgment rejecting a claim for statutory interest because the loan acquired a civil character.
