State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Subject-matter jurisdiction is, in principle, attributed to the court, not its circuits. Assignment of particular actions to the court’s circuits by a decision of its general assembly. Does not constitute subject-matter jurisdiction, but merely an administrative distribution of work among - 668 - Lease those circuits, to which the designation of Court of First Instance applies and which have jurisdiction to adjudicate the dispute even if the assembly assigned it to another circuit. The exception. Cases in which the law, by a special provision, singles out a circuit of the court as having jurisdiction to hear particular matters. This does not preclude its jurisdiction to hear other matters falling within the court’s subject-matter jurisdiction. Example concerning the jurisdiction of the Leasing Circuit of the Court of First Instance and its not being deprived, as one of the court’s circuits, of jurisdiction to hear matters other than tenancy disputes.
