State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The administration’s seizure of real property to allocate it to public benefit without taking the expropriation procedures prescribed in Law 33 of 1964. The property does not acquire the character of public property because the State’s ownership of it has not been established by any legally prescribed means of acquiring ownership. Its effect. Continuation of ownership notwithstanding its seizure - 875 - Ownership with its owner until the issuance of a decision expropriating it for public benefit or a final judgment awarding compensation. The judgment’s departure from this view renders it defective for error in the application of the law.
