Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4469

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that the plaintiff estimates the value of the disputed real estate in the action he brings concerning it. Actions subject to the provisions of Law No. 33 of 2000 concerning Claims to Ownership of State Real Estate are excepted. The value of the real estate must be determined by an expert appointed by the court for this purpose. The Director of the Judicial Fees Department may take appropriate measures to achieve this, including seeking the assistance of whomever he sees fit to estimate its value in actions in which judgment is rendered without the court having assessed their value. The basis thereof.
