Expropriation for public benefit before the promulgation of the Constitution. The source of the Municipality’s right to exercise it, its procedures, and grievances against it. Law No. 33/84 regulated the manner of exercising this right, the conditions for expropriation for public benefit, the authorities undertaking it, and its procedures. Issuance and publication of the expropriation decision and final assessment of compensation. Effect thereof. The expropriated property becomes part of the public domain, and the right of the persons concerned transfers to the value of the corresponding compensation. Possession of it by the expropriated owner confers no right upon him over it. Reason therefor. The property’s not being included in the public project for which it was expropriated. Effect thereof. The Expropriation Department has the option of leaving the property as it stands or notifying the person concerned to recover it if he so wishes.
