State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The administration’s seizure of real property to allocate it to public use without taking the expropriation procedures stipulated in Law 33 of 1964. The property does not acquire the status of public property because the State’s ownership thereof has not been established by any legally prescribed means of acquiring ownership. Its effect. Ownership remains with its owner despite its seizure until a decision is issued expropriating it for public use or a final judgment awarding compensation is rendered. The judgment’s departure from this view vitiates it by an error in the application of the law.
