Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 549

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Loss of the function of an organ in the human body. Requires one diya, namely the diya for the organ, not the diya for its function. The rationale therefor. The function is ancillary to the organ and is lost upon its loss. - Multiplicity of an organ’s functions and loss of one of them as a result of the loss of another or the loss of the multifunctional organ. Does not result in multiple diyas. - Loss by the mind of all mental faculties, the judgment’s assessment of one diya therefor, and its refusal to award multiple diyas for the remaining senses consequent upon the loss of this organ (hearing, smell, and taste). No defect.
