Assessment of compensation making good material and moral damage where the law contains no provision requiring particular standards or methods to be followed. For the court of merits. Its condition. Its identification of the elements of damage and the grounds of the compensation claimant’s entitlement thereto, and its reliance on grounds derived from elements established in the record. - The court of merits may award an aggregate compensation for all damage and is not obliged to adopt the expert’s report in the action.

تقدير التعويض الجابر للضرر المادي والأدبي حال خلو القانون من نص يلزم باتباع معايير أو طرق معينة. لمحكمة الموضوع. شرطه. بيانها عناصر الضرر ووجه أحقية طالب التعويض فيه واعتمادها على أسس مستمدة من عناصر ثابتة بالأوراق. - لمحكمة الموضوع أن تقضي بتعويض إجمالي عن جميع الأضرار ولا إلزام عليها بالأخذ بتقرير الخبير في الدعوى.Original Arabic judgment citations
