Kuwait Court of Cassation principle number 109

Following the procedure for obtaining payment orders. Its becoming mandatory under Decree-Law 44 of 1989, effective on the day following the date of its publication on 23/7/1989, after having been optional. This concerns litigation procedures. This amendment does not apply to actions validly filed before it took effect. Reason therefor. A judicial claim validly made under a particular law remains so even if a new law prescribes a special form for it. Contravention thereof. An error requiring cassation of the judgment.
