Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1360

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The scope of the appeal is determined by what is brought thereof before the Court of Appeal. The reason therefor. What determines the portion of the first-instance court’s ruling challenged on appeal is the relief sought by the appellant in the statement of appeal. Its implication: what the first-instance court has adjudicated and which was not the subject of appeal acquires the force of res judicata.
