Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1423

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of first instance's omission, through error or oversight, to adjudicate one of the claims. It is remedied by returning to the same court for its consideration. The judgment may not be appealed in respect of that claim, and the Court of Appeal may not proceed to adjudicate it, lest it violate the principle of litigation at two levels. The judgment's contravention of this. An error in the application of the law.
