Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1446

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An incidental appeal or cross-appeal transfers the entire dispute determined by the court of first instance to the Court of Appeal, within the limits of the relief sought in them and in the principal appeal. The Court of Appeal has power to determine all aspects of the dispute and may assess maintenance differently from the court of first instance. Basis thereof. - The respondent's filing of a cross-appeal seeking an increase in spousal and minor-child maintenance in its two categories and the rent of the custodial residence. Effect: the Court of Appeal may reassess maintenance as it considers appropriate to meet their needs. Its conclusion that the maintenance awarded suffices only for the respondent's needs in their two categories, excluding housing, on cogent grounds supported by the case papers. The challenge thereto. Unfounded.
