State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments subject to appeal. They may not be compulsorily enforced unless expedited enforcement is provided for by law or ordered in the judgment. The challenged judgment's contravention thereof. A violation of law and an error in its application requiring cassation. - 657 - Civil Procedure - The objective nature of litigation in an annulment action and the independence of its legal basis from the compensation claim do not constitute a sound legal basis for severing their proceedings. Necessary consequence: the judgment rendered in the annulment action may not be challenged separately if a compensation action was brought alongside it. Reason therefor. The obligation to comply with the general rule in Article 128 of the Civil Procedure Law and submit to the requirements of judicial organization. Example.
