Kuwait Court of Cassation principle number 161

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Laws relating to limitation. Their application, from their effective date, to every limitation period not yet completed. - The three-month period prescribed in the third paragraph of Article 33 of the former Printing and Publication Law 3 of 1961, within which an action for compensation must be brought. A forfeiture period. It must be observed before the civil court or the criminal court; otherwise, the right to compensation lapses. The challenged judgment contravening this and applying the new Law 3 of 2006 despite completion of the limitation period before its entry into force. A violation of law requiring its cassation.
