Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 241

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered by the court of first instance as final judgments. The general rule is that they may not be appealed unless the law provides otherwise, or they were rendered contrary to a previous judgment that has not acquired the force of res judicata, or are affected by nullity, or were based on invalid procedures. - The final-instance monetary threshold of the Court of First Instance. Its amendment to five thousand dinars instead of one thousand dinars. The amendment encompasses all disputes, including labor disputes. It applies with immediate effect to judgments rendered after its entry into force. Reason for this. Whether a judgment is open to challenge is governed by the law in force when it is rendered.
