Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 339

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Entitlement to diya or part thereof does not preclude compensation for another injury in itself, provided that their subject matter is not the same. The reason: each independent injury carries an independent diya or compensation and does not merge into another. - If the loss of a sense or function is an inevitable consequence of the loss of another or the loss of an organ having multiple functions, diyas do not multiply. An example of multiple diyas.
