Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 629

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Justice is a public interest exercised by the State within the limits that achieve this interest through its own judiciary, to the exclusion of any foreign judiciary. The international jurisdiction vested in Kuwaiti courts is a matter of public policy. Agreement to exclude the Kuwaiti judiciary in favor of a foreign judiciary. Impermissible. Invoking Article 59 of Law 5/1961 concerning the regulation of relations involving a foreign element does not alter this. Reason therefor.
