English translation of the principle

Judgments issued during the course of an action that do not terminate the proceedings. The rule. They may not be appealed independently. The exception: provisional and urgent judgments, judgments staying the action, and judgments subject to compulsory enforcement. Article 128 of the Civil Procedure Law. The reason thereof. An example concerning the impermissibility of an appeal by cassation against a judgment rejecting a plea that the courts lack jurisdiction to hear the dispute because of a prior arbitration agreement, setting aside the appealed judgment, and remitting the action to the court of first instance for determination on its merits.
