State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A worker's submission of an application concerning his entitlement to the Ministry of Social Affairs and Labour as the sole procedure initiating a judicial claim in labour actions. An exception to the general rules for bringing ordinary actions. The consequence thereof. Confining this procedure to the limits prescribed by the legislature. - Subject-matter jurisdiction is, in principle, attributed to the Court of First Instance, not to its circuits. Assignment of particular actions to the court's various circuits by a resolution of its general assembly. Merely an administrative distribution of work and not a matter of subject-matter jurisdiction. - The jurisdiction of a circuit of the court to hear particular matters pursuant to a special statutory provision. Does not preclude its jurisdiction to hear other matters falling within the court's subject-matter jurisdiction. Example - 514 - Civil Procedure concerning the Labour Circuit.
