Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1031

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court must—when hearing a challenge to an administrative decision—ascertain the existence of its legal constituent elements. Establishment of its flagrant violation of the law renders it nonexistent and strips it of the immunity prescribed for administrative decisions. The consequence: an action concerning it may be brought without adherence to the time limit.
