English translation of the principle

A judicial claim. A procedure directed to the court against the defendant by which the scope of the action is defined for the litigants or the judge. The court's obligation to adhere to this scope when determining the action. - The appellant's claims being confined to cancellation of the order affixing the executory formula to the arbitral award, without including a claim for invalidity of service of the arbitral award bearing the executory formula. Service of this award or a demand to the judgment debtor for payment is not a prerequisite for issuance of the order affixing the executory formula to it, but is required as a preliminary to enforcement following issuance of the order. Its implication. No nullity attaches to the order affixing the executory formula issued before service.
